China Floor Patent Alliance Starts In Beijing

In June 12th, the China floor patent alliance, jointly sponsored by Jiangsu Dewei Wood Industry Co., Ltd. (hereinafter referred to as Dewei wood industry) and Shenzhen Yan gallon Industrial Development Co., Ltd. (hereinafter referred to as Yan Jialong), was officially launched in Beijing. According to the relevant personages, the alliance is made up of the patent of the core technology of the flooring industry. It is composed of many leading enterprises and intellectual property demonstration enterprises. It aims to safeguard the legitimate rights and interests of China's flooring enterprises and enhance the influence of China's flooring industry in the global market.


It is reported that after the establishment of the alliance, the patent pool of the alliance will be constructed in a timely manner, and through the operation of the patent pool, the intellectual property rights barriers set up by the overseas flooring giants should be jointly dealt with. In addition, the alliance will build a public information platform for intellectual property among members of the alliance, establish an innovation award fund, enhance the capability of independent innovation of enterprises, encourage innovation through the cross licensing of patents, and promote industrial development. At the same time, the alliance will play a more active role in safeguarding the legitimate rights and interests of members and enhancing their ability to deal with international litigation. The alliance will organize and coordinate members to respond to international investigations and lawsuits related to patents, and provide technical and financial assistance to patent disputes encountered by members.


It is understood that two flooring enterprises that founded the alliance are relying on core technology patents to win the model in transnational intellectual property litigation. In early 2010, Yan Jia Long filed a lawsuit against Hamburg court in Germany for the unfair competition of the international floor giant Belgian company. The Dewei wood industry launched a 3 year patent lawsuit with Spain's AOSs company. In 2010, Dewei wood finally won the lawsuit. "Facing the current development of the flooring industry, our domestic enterprises should attach importance to the study of international rules and attach importance to the strength of industrial alliances, so that they can be in a favorable position in international competition." Ge Yuejin, chairman of Dewei wood industry, said.


Experts believe that in recent years, China's flooring industry is facing increasingly frequent international trade frictions, which has undergone various technical and trade barriers such as Canada's anti-dumping, countervailing, 337 investigations, and Germany's temporary injunction. How to deal with the export trade frictions actively and safeguard the legitimate rights and interests of the state and enterprises is very important. The establishment of China's floor patent alliance is not only conducive to joint innovation, but also to enhance the ability of flooring enterprises to cope with intellectual property barriers in international trade.


Xiao Luqing, Secretary General of the China Patent Protection Association, said that the establishment of the patent alliance has led enterprises to move from one side to another to seize the market together. Internally, the members of the alliance can strengthen the integration, assimilation and absorption of patent technology and market information by sharing patent resources, improve the efficiency of technological innovation and reduce the cost of innovation; the members of the alliance can jointly make patent licensing or use their form to enhance their international competitiveness and the ability to respond to intellectual property rights.
